Damon & Morey sues own client...again!

As reported in the July 25, 2008 issue of the Buffalo News, one of the area’s largest law firms has sued one of its own clients … again!

According to the News, the Williamsville, New York Village Board voted to fire Damon & Morey, LLP after discovering that the law firm was also representing former Village Administrator Sally Kuzon in her high profile breach of contract law suit against the Village, while at the same time representing the Village on most other legal matters!

Apparently, Damon & Morey has chosen to continue to “thumb its nose” at its legal and professional obligations in pursuit of more fees.

“We just weren’t comfortable continuing with them,” said Trustee Basil Piazza after the Board voted to fire the law firm.

Village Mayor Mary Lowther said that “Damon & Morey did not ask for or receive any conflict-of-interest waivers from the village prior to accepting Kuzon as a client.”

This is not the first time that Damon and Morey has represented one client against another client. In the case of D.A. Elia Construction Corp. vs. Damon & Morey, LLP at least four (4) Damon & Morey attorneys worked on behalf of its creditor client (Construction Pacesetters, Inc.-Lead Creditor) against its debtor client (D.A. Elia Construction Corp.) in the same bankruptcy case. In addition to in-house attorneys, Damon & Morey paid two (2) outside lawyers to also help Construction Pacesetters with its claims against Elia.

In addition to conflicts-of-interest, Damon & Morey clients may be subject to other illegal or unethical practices, such as over-billing. Besides Elia, other recent clients that have taken legal action against the law firm for, among other things, their unscrupulous billing practices include St Rita’s Associates Private Placement LLC, Marta Chaikovska and Creek Ventures, LLC.

Damon & Morey may wish to change its vision statement from “… the practice of law with uncompromising integrity…” to “Conflict? No problem. We can represent both sides.”
